EMPLOYEE INFORMATION TEXT ON THE PERSONAL DATA PROTECTION LAW
 
TEPE BETOPAN A.Ş. (hereinafter referred to as "Company" or "Our Company") takes the necessary security measures to ensure that your personal data is collected, stored and shared in accordance with the law and to protect your privacy.
 
Our purpose is to inform you in the most transparent way about the ways your personal data are collected, the purposes of processing, the persons shared, the legal reasons and your rights in accordance with Article 10 of the Personal Data Protection Law numbered 6698.
  1.  Scope
 
 This Disclosure covers our Company employees.
 
  1. General Information on the Law
 
The Personal Data Protection Law numbered 6698 ("Law") was adopted on March 24, 2016, and published in the Official Gazette numbered 29677 dated April 7, 2016.
 
The Personal Data Protection Law numbered 6698 was adopted to protect the fundamental rights and freedoms of individuals, especially the privacy of personal life, in the collection, processing and storage of personal data, and to regulate the obligations of real and legal persons who process personal data and the procedures and principles they will comply with, and to determine the rights of persons whose personal data are processed.
 
  1. Data Controller
 
AsTEPE BETOPAN A.Ş. ("COMPANY"), in accordance with the Personal Data Protection Law numbered 6698 ("Law"), we will use your personal data in accordance with the legislation.
 
  1. Purpose of Processing Personal Data
 
 The following personal data of the employees of our Company will be processed by our Company for the following purposes and legal reasons and will be kept for the period regulated in the Data Controllers Registry Information System.  
 
  1. In order to fulfill our obligations under the Labor Law, Occupational Health and Safety Law, Social Security Law and related legislation and other laws and legislation, to fulfill the requirements of the employment contract, to keep the personnel file, to follow up and approve paid/unpaid/leave of absence, to view the balance of leave, to make leave arrangements, to create check mark/ payroll, to make wage payments, to make legal notifications in case of work accidents;our personnel's name, surname, date of birth, telephone number, residence and open address information, e-mail address, internal contact information (internal telephone number, corporate e-mail address), bank account information, gender, nationality, country of birth, city of birth, marital status, Turkish ID number, Turkish ID card serial number, father's name, mother's name, signature, employment and termination dates, company entry and exit records, criminal record - conviction information, disability information and degree, military deferment information, number of children, insurance start date, private pension fund name, private pension fund entry date, private pension fund registration number, literacy information, salary and additional income-benefit details, payrolls, premium entitlements, premium amounts, bank passbook, minimum living allowance information, private health insurance amount, blood group information, disease information in health reports, workplace physician records, maiden name, religion information if there is an old type Turkish ID card, wallet number, district/neighborhood of birth, volume number, family sequence number, household number, page number, registration number, place of issue, reason for issue, date of issue information is processed based on the legal reasons that it is necessary to process personal data belonging to the parties to the contract, provided that it is directly related to the establishment or performance of a contract, it is mandatory for the data controller to fulfill its legal obligation, and data processing is mandatory for the establishment, use or protection of a right.
  2. In order to know the background of the employee, to make an evaluation according to the information in the resume in case of appointment or position changes, and to carry out analysis studies within the scope of the " Assessment Center Application";occupation, year and school of graduation, graduation average, educational information (education status, school information, information on courses and seminars where he/she received certificates, knowledge of foreign languages, internship status, trainings he/she attended, information on trainings, evaluation of his/her monthly performance and target achievement status, activity information and performance information, diploma information, visual data, resume, national and international education, assignment, supervision, etc.) Position information is processed based on the legal grounds that data processing is mandatory for the establishment, exercise or protection of a right and that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject, and is transferred to the company we receive support within the scope of the Assessment Center Application based on your explicit consent.
  3. For SSI notifications, İŞKUR notifications, police notifications and incentive and legal obligation notifications; your name, surname, date of birth, Turkish identification number data are processed based on the legal reason that it is mandatory for the data controller to fulfill its legal obligation.
  4. In order to open a compulsory individual pension insurance account; your data on the name, surname, date of birth, Turkish ID number, e-mail address, telephone number, IBAN number, date of employment of our personnel are processed based on the legal reason that it is mandatory for the data controller to fulfill its legal obligation..
  5. In order to ensure workplace safety, to prevent accidents, wrongful acts or criminal incidents that may occur, and to inform the relevant law enforcement officers in case they cannot be prevented; In the company entrances and corridors, office areas, terraces and resting areas, the audio and video data of our personnel with vehicles with audio and video tracking and recording featuresare processed based on the legal reason that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
  6. In order to make payments regarding salary garnishment deductions in line with the instructions of the enforcement directorates; The name, surname, salary information, date of termination of employment, file and debt informationregarding the enforcement proceedings files are processed based on the legal reason that it is mandatory for the data controller to fulfill its legal obligation.
  7. In order to monitor and report the performance of company employees, to make cash advance/expense payments, to create an employee portal, to notify our personnel via web/online platforms, to celebrate their birthdays; The name, surname, date of birth, image data, internal contact information (internal telephone number, corporate e-mail address), bank account information of our personnelare processed based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right and that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
  8. In order to ensure contact and communication, to print business cards, to ensure that packages received by cargo and courier are delivered to the relevant employee, to follow up the use of Company vehicles, to provide shuttle and travel organization, to allocate business e-mails; the name, surname, telephone number, open address information, e-mail address, internal contact information (internal telephone number, corporate e-mail address), Turkish ID number, height, weight, shoe size information of our personnelare processed based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right.
  9. In order to determine whether personal correspondence is made via work e-mail and to obtain traffic and content information of correspondence made via work e-mail in cases specified in the Employment Contract; internet access logs, corporate e-mail address, traffic and content information of correspondence made via corporate e-mail addressare processed based on the legal reason that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
  10. In order to assign trainings to our employees through Tepe Academy, to make training planning, to report trainings, to prepare training certificates, to follow up the employees participating in the actual trainings, to follow up the development processes of the employees as a result of the trainings they receive; the name, surname, internal contact information (mobile phone number, corporate e-mail address), image data, Turkish ID number, department and position information of our personnelare processed based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right and transferred to Infinity Learning Yazılım Hizmetleri A.Ş.
  11. In order to provide our employees with the opportunity to receive free or discounted training through online platforms such as Coursera, Udemy, which change from time to time; the name, surname, corporate e-mail address, and title of our personnelare processed based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right and transferred to the cooperating online training platform.
  12. In order to contact the relatives of our personnel in case of emergency, the name, surname and telephone number information of the relative notified by the employeeis processed based on the legal reason that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
  13. In order to enable our personnel to benefit from shuttle, food and similar services and to contact our personnel when necessary regarding these services; the name, surname, telephone number, open address information, e-mail address, internal contact information (internal telephone number, corporate e-mail address), shuttle routeof our personnel can be processed based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right and can be transferred to suppliers and employees.
  14. Within the scope of the activities of the EMPLOYER, in order to be shared in channels such as advertisements, promotions, announcements, brochures, social media, etc. ; photographs and video recordings taken within the scope of company events (meals, meetings, etc. organizations) or at other times, and audio and video dataof our personnel may be processed subject to their explicit consent.
  15. In order to issue the vehicle stamp required for entering and exiting our company and to ensure traffic safety within the company; the vehicle license plate of our personnel's personal vehicle, the copy of the vehicle license and the copy of the driver's license containing the name, surname, date of birth, place of birthof our personnel can be processed based on the legal reason that data processing is mandatory for the establishment, use or protection of a right and can be transferred to suppliers and employees.
  16. In order to allocate vehicles to our personnel and to monitor the use of the allocated vehicle for business purposes; a copy of the driver's license containing the name, surname, date of birth, place of birth of our personnel, the result of the traffic ticket inquiry, the location information of the vehicle allocated and/or made available to the person and the data on the tracking of gasoline usage and vehicle mileage informationare processed based on the legal reason that data processing is mandatory for the establishment, use or protection of a right and that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned..
  17. In order to increase the service quality of our company, to ensure employee satisfaction, to identify any problems within the company, to identify the reasons for dismissal, to minimize employee circulation; name, surname, date of birth, date of employment, date of resignation, date of employment, date of resignation, title, unit of employment data in the survey conducted during the dismissal procedures;provided that it does not harm the fundamental rights and freedoms of the person concerned, data processing is processed based on the legal reason that it is mandatory for the legitimate interests of the data controller.
  18. In order for our personnel and their relatives to benefit from the discount granted to them at Bilkent University and schools; the name, surname, beneficiary school, department and class information of themselves and their relatives studying at Bilkent schools are processed based on the legal reason that data processing is mandatory for the establishment, exercise or protection of a right and that data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
 
  1. Information on Individuals or Organizations to whom Your Personal Data may be Transferred
 
Your personal data that is collected may be transferred in addition to the above-mentioned purposes:
  1. To persons or organizations required by the Tax Procedure Law, Court of Accounts Law, Labor and Social Security Law, Law on Prevention of Laundering Proceeds of Crime, Law on Prevention of Laundering of Black Money, Turkish Commercial Code, Code of Obligations and other legislation provisions; based on the legal reason that it is mandatory for the data controller to fulfill its legal obligation,
  2. Legally authorized public institutions and organizations, the Ministry of Family, Labor and Social Services, law enforcement officers, prosecutors' offices and other judicial authorities, relevant courts, executive directorates and other administrative and legal authorities that request for legal reasons, based on the legal reason that it is mandatory for the data controller to fulfill its legal obligation,
  3. Since our company is one of the companies subject to audit in accordance with the Turkish Commercial Code numbered 6102, internal and external audit companies and auditors, based on the legal reason that it is mandatory for the data controller to fulfill its legal obligation,
  4. Data is processed based on the legal reason that data processing is mandatory; insurance - private pension companies, occupational health and safety organizations, financial (bank, etc.) institutions, caterers, car rental, airport and similar transfer companies, telephone operators, business card printing companies, etc.,  Law offices, lawyers, archive firms authorized on behalf of our company, consultancy firms and private employment offices that we work with in order to receive consultancy on the determination and calculation of possible incentives to be given by official institutions, to executive assistants-secretariat (only the data necessary for the provision of travel organization of the personnel whose travel organization within the scope of work is provided through executive assistants-secretariat) for the fulfillment of our legal obligations, for the establishment, exercise or protection of a right, and for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject,
  5. Improving Human Resources processes and employee experiences, enabling employees to instantly view and update their own data, instant access to personal information such as leave entitlements and time sheets, preparation of reports on human resources processes with accurate data, healthy planning and recording of training processes, for the purposes of conducting organizational design processes through the system, tracking norm staff, and enabling managers to receive instant and accurate data about their subordinate employees, to the servers of the SAP company in Germany through the company/companies contracted by our company, which is also the intermediary company of the same company in Turkey, based on explicit consent,
  6. In order to improve Human Resources processes and employee experiences, to monitor, evaluate and report the performance of the Company's employees through Microsoft 365 and Azure programs, the servers located in the Netherlands and Ireland of the Microsoft company through the company/companies that are the intermediary company of the same company in Turkey and with which our company has an agreement, based on explicit consent.
 
 
  1. How is your personal data collected?
 
Your Personal Data may be collected verbally, in writing or electronically through information provided by you personally, our websites, Agreements, applications, forms, offers, cookies used by our computer to recognize you during website visits, image recording devices, intermediary companies. 
 
Your personal data will be processed in accordance with the processing conditions specified in Article 5 of the law; if explicit consent is required for the processing of the processed personal data, depending on your explicit consent; otherwise, based on one of the reasons other than the reasons specified in Articles 5 and 6 of the Law (these reasons are mentioned in Article 4 of the clarification text.).
 
  1. Personal Data Owner's Rights Regulated in Article 11 of Law no. 6698
 
As personal data owners, if you submit your requests regarding your rights by the methods set out below, the Company will finalize the request as soon as possible and within thirty days at the latest, depending on the nature of the request. No fee will be charged for up to ten pages in the response. A transaction fee of one Turkish lira will be charged for each page over ten pages. If the response to the application is given in a recording medium such as CD, flash memory, the fee that may be requested by our company will not exceed the cost of the recording medium.
Within this scope, personal data owners have the rights of;
 
  1. To learn whether personal data is being processed,
  2. To request information if personal data has been processed,,
  3. To learn the purpose of processing personal data and whether they are used for their intended purpose,
  4. To know the third parties to whom personal data are transferred both within the country and abroad,
  5. To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
  6. Although it has been processed in accordance with the provisions of Law numbered 6698 and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
  7. To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
  8. In case of damage due to unlawful processing of personal data, to demand compensation for the damage,
  
In accordance with paragraph 1 of Article 13 of the Law numbered 6698 and the Communiqué on the Procedures and Principles of Application to the Data Controller numbered 30356 and dated 10.03.2018, you can submit your request to exercise your rights mentioned above in Turkish and in writing or by using the KEP (registered electronic mail address), secure electronic signature, mobile signature or the electronic mail address previously notified to the Company and registered in our system.
In the applications, only information about the applicant will be provided and it will not be possible to obtain information about other family members and third parties. The Company reserves the right to verify your identity before responding. You must include;
 
  1. Your name, surname and your signature if the application is in writing,
  2. For citizens of the Republic of Turkey, your Turkish ID number; if you are a foreigner, your nationality, passport number or if available ID number,
  3. Your residential or workplace address for the notification,
  4. Your e-mail address, telephone and fax numbers, if available,
  5. Your subject of request
in your application, and information and documents related to the subject, if any, must also be attached to the application.

Depending on the nature of your request, information and documents that will enable identification must be provided to us completely and accurately. If the requested information and documents are not provided as required, there may be problems in the full and qualified execution of the investigations to be carried out by the Company based on your request. In this case, the Company declares that it reserves its legal rights. For this reason, your application must be sent in a complete and complete manner according to the nature of your request and must include the requested information and documents.
